38 Main Street East Update – October 11, 2024
Over the last few months since the last public update in July, the Municipality’s Chief Building Official (CBO) has been working with the property owner of 38 Main Street East and the owner’s engineering firm, CEL, on the implementation of the approved remediation plan to stabilize the Dungarvon Building.
In order to complete these works, the CBO also provided the owner with an extension to complete the plan and an extension to provide documentation required as part of the Unsafe Order issued on May 6, 2024. The required documentation still remains outstanding.
On October 8, 2024, the CBO was formally notified by CEL of the termination of their contract with the property owner, due to the owner undertaking work outside of the scope of the remediation plan and not in accordance with the issued demolition permit. CEL also notified the CBO that, in their opinion, a portion of the building is now less stable due to this work.
This week, the CBO issued a Stop Work Order on the property, as well as an Order to Comply for the property owner to provide a revised evaluation report and design prepared by a professional engineer, with a compliance date of October 16, 2024.
